Green Dot Bank Digital Wallet Terms and Conditions

These Terms and Conditions apply when you add, attempt to add or keep an eligible debit card, prepaid card or other payment device (“Card”) issued by Green Dot Bank (“Green Dot” or “We”) to a digital wallet or other payment service managed or owned by a third party (herein, collectively referred to as a “Digital Wallet”).  These Terms and Conditions apply to you and anyone else that you authorize to use your Card in connection with a Digital Wallet.

These Terms and Your Account Terms.

These Terms and Conditions do not affect or change your underlying agreements with Green Dot.  A Digital Wallet is just another way to use your Card to make purchases of products and services at locations that accept Digital Wallet payments.  Digital Wallets may not be accepted at all places where your Card is accepted.  Just as Green Dot is not responsible for the delivery of products and services purchased from a merchant with your Card, Green Dot is also not responsible when you use your Card in a Digital Wallet for such purchases.  Similarly, warranties related to the products or services and any damage, returns, or other disputes related to the products or services are solely issues between you and the applicable merchant.

Digital Wallets and Green Dot.

Only Green Dot Cards that we determine are eligible can be added to a Digital Wallet. Green Dot is not the provider of the Digital Wallet and is not responsible for any information or services provided by the Digital Wallet provider, your mobile network operator, or third parties associated with a Digital Wallet.  We are not responsible for any failure (including security failures) related to your use of a Digital Wallet for your transactions and we have no responsibility for a Digital Wallet’s availability.  It is your responsibility to decide whether to use a Digital Wallet and to read and understand any other agreements related to a Digital Wallet before activating or using your Card in a Digital Wallet.

Transaction History.

You agree and acknowledge that the transaction history displayed in the Digital Wallet solely represents our authorization of your Digital Wallet transaction and may not reflect complete information about the transaction, nor any post-authorization activity, including but not limited to clearing, settlement, foreign currency exchange, reversals, returns or chargebacks. Accordingly, the purchase amount, currency, and other details for the Digital Wallet provider’s transaction history in connection with use of your Card in the Digital Wallet may be preliminary and/or incomplete, and may not match the transaction amount that ultimately clears, settles, and posts to your Card.

Lost or Stolen.

If your mobile device has been lost or stolen, your Digital Wallet authentication (e.g., fingerprint or similar authentication method, or PIN) has been compromised, or if your Card has been lost, stolen, or used without your permission, you must notify us immediately, following the procedures described in your Card agreement.  Failing to notify us promptly may result in you being liable for any losses related to unauthorized use of your Card. 

Fees.

Any applicable fees and charges that apply to your Card will also apply when you use a Digital Wallet to access your Card.  Green Dot does not currently impose a fee for using your Card in a Digital Wallet.  However, the Digital Wallet or your mobile network operator may impose certain charges or other fees for use of a Digital Wallet (including, but not limited to, charges for texting and/or data usage). 

Your Privacy When Using a Digital Wallet

When you are using your Card in a Digital Wallet, Green Dot will collect, use and disclose your personal information in accordance with the privacy policy applicable to your Card/account that may be amended from time to time.  However, the Digital Wallet provider and other third parties that allow Digital Wallets to work will also have access to certain information such as details of Card transactions made using a Digital Wallet.  Green Dot is not responsible for how these parties may use this information.  Please review the Digital Wallet providers’ privacy policies carefully for more information.

Account Security.

You are solely responsible for maintaining the confidentiality of: your Digital Wallet User ID and related passwords; Card; and any other confidential information regarding your Card and/or Digital Wallets.  Digital Wallet providers may make available certain security features and procedures to help protect against unauthorized use of the Card and/or Digital Wallet.  You agree not to disable any of these security features and must use these security features and procedures to safeguard your Card and use of the Digital Wallet.

Suspending Use of Your Card in a Digital Wallet.

Green Dot may suspend its participation in a Digital Wallet at any time, and without prior notice to you (although we will provide prior notice, if possible).  Further, even if Green Dot continues to participate in a Digital Wallet, Green Dot may suspend or cancel your use of your Card in the Digital Wallet at any time without notice and for any or no reason.  Green Dot also reserves the right to designate a maximum number of Cards that may be added to a Digital Wallet.  You agree that Green Dot will not be liable to you or any third party for any blocking, suspension, cancellation, or termination of your use of your Card in a Digital Wallet. 

Limitation of Liabilities.

Except as otherwise provided by law, in no event will Green Dot, its direct or indirect subsidiaries, its parent company, affiliates, stockholders, directors, officers, agents, employees, or representatives be liable for death, personal injury, property damage, or any incidental, special, indirect, punitive, exemplary, or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of or damage to data, business interruption, or any other commercial or financial damages, lost revenues, or other losses of any kind, arising out of these Terms and Conditions or related to use of your Card (or inability to use your Card) in a Digital Wallet.

Change in Terms.

Green Dot may change any or all of these Terms and Conditions from time to time and for any reason.  We can also assign these Terms. You cannot change these terms, but, with respect to your Card, you may terminate your participation in a Digital Wallet at any time by removing your Card from the Digital Wallet, consistent with the Digital Wallet provider’s account removal procedures.  We are not responsible for any errors, delays, glitches, or malfunctions (or incidental consequences arising therefrom) associated with any attempt to remove your Card from a Digital Wallet. You may not assign these Terms.  If required, we will notify you of changes involving these Terms and Conditions.

Governing Law and Disputes.

These Terms and Conditions are governed by federal law and, to the extent that state law applies, the laws of the state that apply to the agreement under which your Card is covered. Disputes arising out of or relating to these Terms and Conditions will be subject to any dispute resolution procedures in your Card agreement.
