ELECTRONIC COMMUNICATIONS AGREEMENT

By agreeing to the Electronic Communications Agreement, you agree and provide your electronic signature to this Electronic Communications Agreement. Under this Electronic Communications Agreement, you agree that Green Dot Corporation (“we” or “us”) may provide agreements and disclosures related to the cards, accounts and all related services to you electronically (via email or on our website) instead of in paper form. During the term that you maintain an account with us, you agree to provide us with and maintain a valid email address for information that will be delivered by email and that you will promptly notify us of any change in your email address. You understand that our ability to provide you information by email is dependent upon the maintenance of a valid email address. For information that will only be provided via our website, such as periodic statements/transaction histories, it is your responsibility to check the website for current information.

Electronic Records and Communications Act Disclosures

You consent, understand and agree that: (i) this Agreement will be entered into electronically, (ii) you meet the minimum access requirements specified below, (iii) the consent shall last until you withdraw consent, and (iv) the following categories of information
may be provided by electronic communication:

  • Agreements (including the Cardholder Agreement) and disclosures and amendments thereto
  • Privacy Policy of Green Dot Bank
  • Balance, activity and certain other information on your account(s)
  • Periodic statements, authorizations and transaction histories for your account(s)
  • Notices to you of the resolution of any claimed error on your periodic statements
  • Notices with respect to any changes to the Agreement or any other notices or communications required or permitted by law or
    regulation including, without limitation, notices of changes in terms provided under Regulation E
  • Inquiries or notices to you about transactions made

We may mail paper copies of any of the foregoing, in addition to or instead of sending them to you electronically, at our discretion.

You have the right to withdraw your consent to have future instances of the above-referenced categories of information made available to you by electronic communication. If you withdraw your consent, you will no longer be able to utilize our Online Bill Pay or Online Bank Transfer services, as applicable. This means that you will not be able to use the service to make online bill payments or transfers to or from your prepaid or other bank accounts. In addition, you may experience a delay in obtaining information regarding your Accounts. Your withdrawal shall not apply to information properly provided before the withdrawal takes effect.

To withdraw your consent, after logging in to your account, visit Change Preferences, and update your preference from the Electronic Communications Agreement option. To update your contact information, call us at 1-866-795-7597. The withdrawal of consent will take effect no more than fourteen (14) calendar days after you provide us with notice of the withdrawal.

You may obtain a paper copy of any electronic communications (including a copy of this Agreement) free of charge by providing a written request addressed to Green Dot Corporation/Green Dot Bank, PO Box 1187, Monrovia. CA 91017. Such a request will not be considered a withdrawal of consent to receive information by electronic communication unless you expressly withdraw your consent in such request.

In order to receive the categories of information referenced above by electronic communication, you must have the following hardware and software requirements:

  • a personal computer
  • Microsoft Windows 2000, Microsoft Windows XP with Service Packs 1 and 2, Microsoft Vista, Microsoft Windows 7, or Mac OS 10.X or higher
  • a secure (encrypted) Web Browser (Firefox 3.6 or higher, Internet Explorer 8.0 or higher, Chrome 4.0 or higher, Safari 4.0 (Mac) or higher)

Termination or Modification of Mobile Alert Services

Green Dot reserves the right to suspend, terminate, modify and/or begin charging for the Service without liability at any time without prior notice to you.

Green Dot may deactivate the sending of Mobile Alerts to you if your Card is not used for a purchase, ATM transaction, or reload for a period of sixty (60) days. If Mobile Alerts are deactivated for your Card and you resume use of your Card and wish to restore Mobile Alerts, you will be required to re-enroll your Card in the Mobile Alerts service to restore Mobile Alerts.

Your Security Obligations

You hereby acknowledge and accept that each Mobile Alert may be sent to you without being encrypted and may include your name and information pertaining to your Card. Depending upon which Alerts you select, information such as your account balance may be included. Anyone with access to your mobile device will be able to view the contents of these Alerts.

It is your responsibility to: ensure the security of your mobile device; determine if your wireless provider supports SMS; and ensure your mobile device is capable of receiving SMS. You acknowledge that message and data rates may apply. You are solely responsible for any fees imposed of any kind whatsoever by your wireless service provide.

Limitations and Indemnification

You acknowledge and agree that your receipt of any Mobile Alert may be delayed or prevented by factor(s) outside of Green Dot’s control, including factors affecting your wireless service provider and coverage in your area. We do not guarantee the delivery, timeliness or accuracy of the contents of each Mobile Alert. The Service is subject to transmission limitations and service interruptions. You agree to indemnify, defend and hold Green Dot and its directors, officers, employees and agents (collectively, “Released Parties”) free and harmless from any and all losses or damages, including attorneys' fees, including, but not limited to, to those relating to bank secrecy or financial privacy laws or regulations, that may arise, directly or indirectly, in whole or in part, from: a non-delivery, delayed delivery, or the misdirected delivery of a Mobile Alert; inaccurate or incomplete content in a Mobile Alert; your reliance on or use of the information provided in a Mobile Alert for any purpose; or any third party, whether authorized or not, obtaining information regarding your Card disclosed in the Mobile Alerts by accessing your mobile device. THE RELEASED PARTIES DISCLAIM ANY RESPONSIBILITY AND ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE. The Service allows you to request and receive E-mail Alerts about your Card. We send E-mail Alerts to you based upon the instructions you provide to us. These instructions include your correct email address(es). Your instructions are neither reviewed nor verified by Green Dot prior to or following activation of the Service. You may unsubscribe from E-Mail Alerts anytime by managing your Account Alert preferences on the account management page.

Termination or Modification of E-Mail Alert Services

Green Dot reserves the right to suspend, terminate, modify and/or begin charging for the Service without liability at any time without prior notice to you.

Green Dot may deactivate the sending of E-mail Alerts to you if your Card is not used for a purchase, ATM transaction, or reload for a period of sixty (60) days, or if the Card balance is at or below $0.00 for seven (7) days. If E-mail Alerts are deactivated for your Card and you resume use of your Card or restore a positive balance and wish to restore E-mail Alerts, you will be required to re-enroll your Card in the E-mail Alert service to restore E-mail Alerts.

Your Security Obligations

You hereby acknowledge and accept that each E-mail Alert may be sent to you without being encrypted and may include your name and information pertaining to your Card. Depending upon which alerts you select, information such as your account balance may be included. Anyone with access to your email will be able to view the contents of these Alerts.

It is your responsibility to ensure the security of your e-mail account. You are solely responsible for any fees imposed of any kind whatsoever by your Internet service provider.

Limitations and Indemnification

You acknowledge and agree that your receipt of any E-mail Alert may be delayed or prevented by factor(s) outside of Green Dot’s control, including factors affecting your Internet service provider and coverage in your area. ELECTRONIC COMMUNICATIONS AGREEMENT

By agreeing to the Electronic Communications Agreement, you agree and provide your electronic signature to this Electronic Communications Agreement. Under this Electronic Communications Agreement, you agree that Green Dot Corporation (“we” or “us”) may provide agreements and disclosures related to the cards, accounts and all related services to you electronically (via email or on our website) instead of in paper form. During the term that you maintain an account with us, you agree to provide us with and maintain a valid email address for information that will be delivered by email and that you will promptly notify us of any change in your email address. You understand that our ability to provide you information by email is dependent upon the maintenance of a valid email address. For information that will only be provided via our website, such as periodic statements/transaction histories, it is your responsibility to check the website for current information.

Electronic Records and Communications Act Disclosures

You consent, understand and agree that: (i) this Agreement will be entered into electronically, (ii) you meet the minimum access requirements specified below, (iii) the consent shall last until you withdraw consent, and (iv) the following categories of information
may be provided by electronic communication:

  • Agreements (including the Cardholder Agreement) and disclosures and amendments thereto
  • Privacy Policy of Green Dot Bank
  • Balance, activity and certain other information on your account(s)
  • Periodic statements, authorizations and transaction histories for your account(s)
  • Notices to you of the resolution of any claimed error on your periodic statements
  • Notices with respect to any changes to the Agreement or any other notices or communications required or permitted by law or
    regulation including, without limitation, notices of changes in terms provided under Regulation E
  • Inquiries or notices to you about transactions made

We may mail paper copies of any of the foregoing, in addition to or instead of sending them to you electronically, at our discretion.

You have the right to withdraw your consent to have future instances of the above-referenced categories of information made available to you by electronic communication. If you withdraw your consent, you will no longer be able to utilize our Online Bill Pay or Online Bank Transfer services, as applicable. This means that you will not be able to use the service to make online bill payments or transfers to or from your prepaid or other bank accounts. In addition, you may experience a delay in obtaining information regarding your Accounts. Your withdrawal shall not apply to information properly provided before the withdrawal takes effect.

To withdraw your consent, after logging in to your account, visit Change Preferences, and update your preference from the Electronic Communications Agreement option. To update your contact information, call us at 1-866-795-7597. The withdrawal of consent will take effect no more than fourteen (14) calendar days after you provide us with notice of the withdrawal.

You may obtain a paper copy of any electronic communications (including a copy of this Agreement) free of charge by providing a written request addressed to Green Dot Corporation/Green Dot Bank, PO Box 1187, Monrovia. CA 91017. Such a request will not be considered a withdrawal of consent to receive information by electronic communication unless you expressly withdraw your consent in such request.

In order to receive the categories of information referenced above by electronic communication, you must have the following hardware and software requirements:
